4 Things to Know About the OSHA COVID-19 Testing & Vaccination Executive Order

RULE OF 100 ─ COUNTING EMPLOYEES

Employers with 100 or more workers have two options: ensure employees are fully vaccinated against COVID-19 or provide a weekly negative COVID test for every unvaccinated employee. So, how do you count your number of employees? In short, there is no employee left out of the tally. A company’s number of workers includes every employee across all US locations, part-time, seasonal, and work–from–home employees. Even if your people do not report to a workplace or work exclusively outdoors, the rule still applies.

PAID TIME OFF FOR VACCINATIONS

OSHA states that employers must pay employees for the time it takes to get vaccinated and for any recovery time associated with side effects. Many employers are providing on-site vaccine clinics rather than slowing production with time off for every employee vaccination.

MAINTAINING TESTING RECORDS

Unvaccinated employees must provide the documentation for a negative COVID test every seven days. Employers are required to maintain a copy of each negative test record once the mandate goes into effect. Providing testing for your employees is not required, but to ensure on-time tests and compliance documentation, employers are making a plan to provide on-site testing to avoid OSHA’s hefty $13,653 fine per employee violation.

UNVACCINATED MASKING REQUIREMENT

All unvaccinated employees must begin wearing masks in the workplace. Standard mask exemptions apply to the rule ─ employees may remove their mask when alone in a room with floor to ceiling walls and when eating or drinking.
